Frequently Asked Questions

What does the EmpCo Readiness Check do?

It asks a few short questions about how you make and back up environmental claims, then shows your EmpCo exposure risk, low, moderate, or high, along with the areas most at risk and a toolkit to help you close the gaps. It takes about a minute and is free.

When does the EmpCo Directive apply?

The directive entered into force on 26 March 2024. Member states had to transpose it into national law by 27 March 2026, and the rules apply across the EU from 27 September 2026. In Germany, the transposition was published in the Bundesgesetzblatt on 19 February 2026.

What are the penalties for breaching EmpCo?

Each EU member state sets its own penalties through national consumer law. The EU-wide floor requires fines of at least 4% of a trader's annual turnover in the market concerned, or at least 2 million euros where turnover cannot be established. National ceilings often go further, and fines apply per market, so one claim sold across borders can be penalized in several countries at once.

Is the EmpCo Readiness Check legally binding?

No. The check provides general guidance based on the EmpCo Directive (EU 2024/825). It does not constitute legal advice or certify EmpCo conformity. For a formal assessment, consult a regulatory specialist or speak with our team.
